Terms and Conditions

1. Agreement to Terms

By accessing and using the LA Flooring website ("Site") or engaging our services, you ("Customer") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and LA Flooring, Inc. ("LA Flooring," "we," "us," "our"), a Florida flooring retailer and installer located at 336-C Shopping Center Dr, Wildwood, FL 34785. If you do not agree to these Terms in their entirety, do not use this Site or engage our services.

2. Estimates and Quotes

Free Estimates: LA Flooring offers free in-home estimates for flooring materials and installation within our standard service area. Estimates are based on an in-home measurement and material selection conducted by a LA Flooring representative.

Quote Validity: Written quotes are valid for 30 calendar days from the date of issue unless otherwise stated. Material pricing is subject to change due to manufacturer price increases, supply chain fluctuations, and dye lot availability. We will notify you of any material price changes before your order is placed.

Binding Agreement: No services will begin until Customer has signed a written proposal or work order and paid the required deposit. Verbal agreements, email confirmations, and website submissions do not constitute a binding contract for services.

Exclusions: Estimates exclude costs for unforeseen subfloor conditions, additional removal of existing flooring materials not identified during the estimate visit, removal of non-standard adhesives (glue-down flooring, carpet padding bonded to concrete), stair nosing, transitions between multiple floor heights, or any structural repairs required to achieve a proper installation surface.

3. Payment Terms

Deposit Requirement: A non-refundable deposit of 50% of the total contract value is required to place a material order and schedule installation. For custom tile, stone, or specialty orders, a deposit of up to 100% may be required once materials are ordered, as custom and special-order materials cannot be returned to the manufacturer.

Final Payment: The remaining balance is due upon completion of the installation, before LA Flooring crew departs the jobsite. Completion is defined as the final installation of all flooring materials specified in the work order, including transitions, thresholds, and base molding (where included in scope).

Accepted Payment Methods: Cash, check, major credit cards, and approved financing. Checks returned for insufficient funds will be subject to a $35 returned check fee. A 3% convenience fee applies to credit card payments over $2,500.

Financing: LA Flooring may offer third-party financing options subject to credit approval. Financing terms are governed by the financing provider's agreement, which is separate from these Terms.

Overdue Accounts: Amounts unpaid 10 days after the due date are subject to a 1.5% monthly finance charge (18% annually). Customer agrees to pay all collection costs, court costs, and reasonable attorney's fees incurred in collecting overdue amounts.

4. Returns, Refunds, and Cancellations

Standard In-Stock Materials: Unopened, uninstalled materials in original manufacturer packaging may be returned within 14 days of purchase for store credit, less a 25% restocking fee. No refunds will be issued; store credits are valid for 12 months.

Custom and Special Orders: Custom-ordered materials, special-order tile, custom-cut stone, stair nosings, and any product ordered from a manufacturer for a specific project are non-returnable and non-refundable once the order is placed with the supplier. This includes products that are back-ordered or delayed by the manufacturer.

Installed Materials: No returns or refunds are available for materials that have been installed, modified, or cut.

Cancellation: If Customer cancels a project after a deposit has been paid but before materials are ordered, LA Flooring will retain 15% of the total contract value as a cancellation and administrative fee, and refund the remainder. If materials have been ordered at the time of cancellation, Customer is responsible for the full cost of materials ordered plus the 15% cancellation fee, with any remainder refunded.

LA Flooring Cancellation: If LA Flooring is unable to complete the project due to circumstances within our control, Customer will receive a full refund of all deposits paid.

5. Material Quantities and Overage

Overage Policy: All material estimates include an industry-standard overage allowance of 10–15% above measured square footage to account for cuts, waste, pattern matching, and future repairs. The specific overage percentage varies by product type and pattern complexity. Customer is responsible for the full cost of materials estimated and ordered, including the overage allowance.

Leftover Materials: Any flooring materials remaining after installation become the property of the Customer and should be retained for future repairs. LA Flooring recommends storing at least one box of finished flooring in a climate-controlled environment. We are not responsible for storing leftover materials.

Material Shortages: If actual square footage measured at installation differs from the estimate by more than 5%, Customer will be invoiced for the difference at the prevailing material price, which may vary from the original quote due to dye lot differences or price changes.

Ordering Policy: Materials are ordered in full-box quantities. LA Flooring will not order partial boxes; Customer will be charged for the full box regardless of how many pieces are used.

6. Color, Pattern, and Dye Lot Variation

Natural Variation: All flooring products, including hardwood, luxury vinyl plank, ceramic tile, porcelain tile, natural stone, carpet, and laminate, exhibit natural variation in color, tone, pattern, texture, and shading. This variation is a characteristic of the product, not a defect. LA Flooring is not responsible for variation between the product as shown in samples, showroom displays, digital photographs, or website images and the installed product.

Dye Lots: Flooring is manufactured in production runs ("dye lots") that may differ in shade and tone from other production runs of the same SKU. LA Flooring orders all materials for a project from the same dye lot where possible. However, if materials are reordered at a later date (e.g., for repairs), an exact dye lot match cannot be guaranteed. Customer acknowledges this risk when adding extensions or reorders.

Sample Accuracy: Samples are representative of the product and its natural variation range. Acceptance of a sample and signing of the work order constitutes acknowledgment and acceptance of potential color and pattern variation in the installed product.

Tile and Stone: Natural stone (travertine, marble, slate, granite, limestone) exhibits significant veining, color variation, and pitting that are inherent characteristics. Tile patterns may vary by box. LA Flooring installers will mix tiles from multiple boxes during installation to distribute variation; however, Customer may still notice differences between individual tiles.

7. Subfloor and Site Preparation Requirements

Customer Responsibility: Customer is responsible for ensuring the installation area is clear of all furniture, appliances, personal belongings, area rugs, and drapes prior to the scheduled installation date. Additional charges apply if LA Flooring crew must move furniture.

Furniture Moving: LA Flooring offers furniture moving as an optional service for an additional fee. We will move standard household furniture (sofas, beds, dressers, dining tables, chairs). We will not move pianos, gun safes, large appliances, waterbeds, aquariums over 30 gallons, pool tables, exercise equipment, or any item requiring disassembly. Customer assumes all responsibility for valuables, fragile items, and items moved at Customer's request.

Subfloor Conditions: Subfloors must be clean, dry, flat (within 3/16 inch over a 10-foot span per industry standards), and structurally sound prior to installation. LA Flooring will inspect the subfloor upon arrival. If subfloor preparation (grinding, self-leveling compound, patching, or board replacement) is required beyond the scope of the estimate, additional labor and material charges will apply. LA Flooring will notify Customer of any additional charges before proceeding.

Moisture Testing: LA Flooring recommends moisture testing of concrete subfloors prior to installing wood, laminate, or certain LVP products. Failure to disclose or address known moisture issues before installation voids any labor warranty. If moisture levels exceed manufacturer guidelines, installation may be delayed or refused until the condition is remediated.

Existing Floor Removal: Removal of existing flooring is included only when specified in the written work order. Removal of glued-down hardwood, VCT tile, mortar-bed tile, or carpet bonded with specialty adhesive may involve additional labor charges not included in standard removal pricing.

Asbestos: Flooring materials installed before 1980 may contain asbestos-containing materials (ACM), including vinyl tiles, backing, and adhesives. LA Flooring will not perform removal of suspected ACM. Customer must engage a certified asbestos abatement contractor prior to scheduling flooring installation if ACM is suspected or confirmed.

8. Standard Flooring Installation Terms

Scope of Work: LA Flooring will install flooring materials as specified in the signed work order. The scope includes material installation, transitions between flooring surfaces, and reinstallation of shoe molding or quarter round as specified. It does not include base molding installation (unless specified), painting, drywall repair, or any work unrelated to flooring.

Industry Standards: All installations are performed in accordance with the manufacturer's installation guidelines and applicable NWFA (National Wood Flooring Association), TCNA (Tile Council of North America), or equivalent industry standards. LA Flooring will not install materials in conditions that violate manufacturer guidelines (e.g., insufficient moisture barrier, inadequate subfloor flatness).

Acclimation: Hardwood and certain laminate products require acclimation in the installation environment for 48–72 hours (or per manufacturer specifications) before installation. Customer must make the installation area accessible, heated/cooled to normal living conditions, and free of construction activities during acclimation. LA Flooring is not responsible for problems arising from failure to acclimate materials properly.

Baseboards and Trim: LA Flooring will reinstall existing shoe molding or quarter round that is removed during installation where feasible. We are not responsible for damage to old, brittle, or previously painted molding that breaks during removal. New molding is available for an additional material and labor charge.

HVAC Requirements: The installation area must be maintained at normal living temperature (between 65°F and 85°F) and humidity (30–60% relative humidity) before, during, and after installation. Failure to maintain these conditions may void the manufacturer's warranty and LA Flooring's labor warranty.

9. Custom Tile, Bathroom, Kitchen, and Shower Installation

Scope of Custom Work: Custom tile installation for kitchens, bathrooms, showers, backsplashes, and wet areas involves additional considerations beyond standard flooring installation. All work described in this section is subject to a separate detailed work order specifying materials, patterns, grout selections, and scope.

Waterproofing (Shower and Wet Areas): LA Flooring installs shower and wet-area tile systems in accordance with TCNA handbook guidelines. Waterproofing membrane installation is included in shower scopes as specified in the work order. LA Flooring is not responsible for pre-existing plumbing defects, substandard framing, or water damage unrelated to our installation.

Shower Surrounds and Pans: Removal and replacement of existing shower pans, prefabricated surrounds, or damaged cement board is available as an additional service and must be specified in the work order. Preexisting plumbing rough-in must meet code. Customer is responsible for any required plumbing modifications prior to the installation appointment.

Kitchen Backsplash: Backsplash tile installation requires the area to be free of outlets, switch plates, and applicable obstructions prior to our arrival. LA Flooring will reinstall outlet covers upon completion. Customer is responsible for coordinating any required electrical work. Grout haze and minor dust are normal and should be cleaned per the grout manufacturer's instructions provided at project completion.

Grout and Curing: Grout must cure a minimum of 24 hours before light use and 72 hours before wet use (for showers and wet areas). Customer must not use the shower, backsplash, or floor for the recommended curing period. Premature use may compromise grout integrity and void the labor warranty.

Material Lippage: Minor lippage (variation between adjacent tile faces) is inherent to large-format tile (12x24 and larger) and is considered acceptable if within TCNA guidelines. Lippage is not considered a defect unless it exceeds 1/32 inch for rectified tile or 1/16 inch for non-rectified tile in a thinset application.

Design Consultations: LA Flooring provides complimentary design guidance to help Customers select materials, patterns, and grout colors. Design recommendations are advisory only. Customer accepts full responsibility for final material selections, including color choices, pattern selections, and grout colors.

10. Warranties

LA Flooring Labor Warranty: LA Flooring warrants all installation labor against defects in workmanship for a period of one (1) year from the date of installation. This warranty covers installation defects such as loose tiles, gaps beyond normal expansion, and adhesive failures attributable to improper installation technique. It does not cover product defects, material failures, normal wear and tear, damage from moisture/flooding, improper maintenance, structural movement, or conditions outside LA Flooring's control.

Manufacturer Product Warranty: All flooring products are sold with the manufacturer's warranty as provided with the product. Manufacturer warranties vary by product and brand; LA Flooring will provide warranty documentation with your order. To make a manufacturer warranty claim, contact LA Flooring and we will assist in facilitating the claim process. Manufacturer warranties require proper installation per guidelines, maintenance per manufacturer instructions, and use within rated conditions (commercial vs. residential, traffic class, etc.).

Hardwood Warranty: Engineered and solid hardwood carry manufacturer warranties ranging from 25 years to lifetime for structural integrity and finish wear, subject to proper care. Hardwood flooring is not warranted against cupping, gapping, or buckling resulting from moisture infiltration, HVAC failure, or seasonal humidity changes beyond normal Florida ranges.

LVP/Vinyl Warranty: Luxury vinyl plank and tile products typically carry 10–25 year wear warranties subject to residential use and manufacturer maintenance requirements. Warranty coverage for commercial applications may be limited or excluded.

Tile and Stone Warranty: LA Flooring warrants tile and stone installation labor per the terms above. Natural stone is not warranted against etching, staining, or damage from acidic cleaners, which are normal characteristics of natural stone.

Carpet Warranty: Carpet manufacturers provide fiber warranties, stain resistance warranties, and texture retention warranties varying by product line. LA Flooring's labor warranty covers power stretching and seaming defects for one year from installation.

Warranty Exclusions: All warranties (labor and manufacturer) are void if: (1) flooring is subjected to abnormal moisture or flooding; (2) improper cleaning products or methods are used; (3) Customer or third parties perform modifications, repairs, or additional installation without LA Flooring authorization; (4) failure to maintain recommended temperature and humidity; (5) physical damage from furniture, animals, or heavy objects; or (6) normal wear and tear consistent with product traffic rating.

11. Change Orders

Any changes to the scope of work, materials, or schedule after the work order is signed require a written change order approved by both parties. Verbal change orders are not binding. Additional work will be priced at LA Flooring's prevailing rates and added to the final invoice. Scope changes may affect project scheduling and material availability.

12. Scheduling, Delays, and Force Majeure

Scheduling: Installation dates are confirmed upon receipt of the required deposit. LA Flooring will make reasonable efforts to meet scheduled installation dates; however, installation dates are estimates and are subject to change based on material lead times, prior job completion, crew availability, and conditions outside our control.

Customer Delays: If Customer is not ready for installation on the scheduled date (site not prepared, furniture not moved, subfloor issues not addressed), a rescheduling fee of $150 may apply. Materials already delivered to the site remain Customer's responsibility.

Force Majeure: LA Flooring shall not be liable for delays or non-performance caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, hurricanes, flooding, supply chain disruptions, manufacturer delays, pandemics, acts of government, or labor disputes.

13. Customer Responsibilities

  • Disclose all known conditions (moisture issues, previous water damage, asbestos, uneven subfloors) before the estimate visit
  • Clear the installation area of all furniture, appliances, valuables, fragile items, and personal belongings before the installation crew arrives
  • Ensure the space is heated/cooled to normal living conditions (65–85°F, 30–60% RH) at least 24 hours before installation
  • Secure pets during installation
  • Make a representative available to approve work and sign off on completion
  • Allow adequate drying and curing time for tile, stone, and adhesive-applied products
  • Follow the maintenance instructions provided with your flooring product

14. Limitation of Liability

To the maximum extent permitted by applicable Florida law, LA Flooring's total liability for any claim arising out of or related to our services shall not exceed the total amount paid by Customer for the specific service giving rise to the claim. LA Flooring shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of revenue, or damage to property not caused by our direct negligence.

Nothing in these Terms limits LA Flooring's liability for gross negligence, willful misconduct, or liability that cannot be limited under applicable law.

15. Dispute Resolution and Governing Law

Governing Law: These Terms and any disputes arising from them are governed by the laws of the State of Florida, without regard to conflict of law principles.

Venue: Any legal action or proceeding relating to these Terms or LA Flooring's services shall be brought exclusively in the state or federal courts located in Sumter County, Florida. Customer consents to personal jurisdiction and venue in Sumter County, Florida.

Informal Resolution: Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes informally by contacting LA Flooring at [email protected] or 352-748-0200. We will make good-faith efforts to resolve disputes within 30 days.

Mediation: If informal resolution fails, both parties agree to participate in non-binding mediation administered by a mutually agreed mediator in Sumter County before initiating litigation.

Attorney's Fees: In any legal proceeding arising from these Terms, the prevailing party shall be entitled to recover reasonable attorney's fees and costs to the extent permitted by Florida law.

16. Intellectual Property

All content on this website, including text, images, photographs, product descriptions, logos, page layouts, and software code, is the property of LA Flooring or its licensed content suppliers and is protected by United States and international copyright law. You may not reproduce, modify, distribute, display, transmit, or create derivative works from any content on this site without the express written permission of LA Flooring.

17. Website Accuracy and Disclaimer

LA Flooring makes reasonable efforts to keep the information on this website accurate and current. However, we make no warranties, express or implied, regarding the completeness, accuracy, or reliability of any website content. Product pricing, availability, and specifications are subject to change without notice. Images and renderings on the website are for illustrative purposes only and may not represent the exact color, texture, or pattern of the actual product.

18. Changes to These Terms

LA Flooring reserves the right to update or modify these Terms at any time without prior notice. The "Last Updated" date at the top of this page indicates the effective date of the current version. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
